Most post-first-trimester abortions were banned by Initiative 434. Rape, incest, and life-threatening pregnancies are exempt. With 55% support, Initiative 434 confirmed Nebraska’s 12-week abortion limit in the constitution.
Two anti-abortion measures were on the ballot, a rare occurrence. Initiative 439, the second measure, would have allowed abortions until fetal viability, usually 20–24 weeks. This measure failed with 51% voter opposition.
Initiative 434 supporters say it upholds Nebraska values by protecting “the dignity of both mothers and unborn children.” Protect Women and Children, which supported the amendment, believes Nebraska has joined other conservative states in restricting abortion.
Abortion-rights advocates worried about the amendment’s effects on women’s health and rights. Planned Parenthood Advocates of Nebraska expressed disappointment, fearing the amendment would tighten abortion laws. People also worry that more women will have to travel out of state for reproductive care.
The Nebraska legislature can now impose more restrictions or bans. Gov. Jim Pillen called it a “great day for unborn babies in Nebraska.” Many pro-choice supporters believe this amendment expands reproductive rights restrictions, setting the stage for future legal battles.
